TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) govern your access to and use of Witness (the “App”) and any related services (collectively, the “Services”) provided by Motion Ventures LLC (“Company,” “we,” “us,” or “our”).

By downloading, accessing, or using Witness, you agree to be bound by these Terms. If you do not agree, do not use the Services.

 

1. USE OF THE SERVICES

Witness is a personal safety and evidence preservation tool designed to allow users to record video, securely upload content, and share recordings with trusted contacts (“Trusted Circle”).

Witness does not provide emergency services, law enforcement response, legal advice, or medical assistance.

You acknowledge that:

  • Witness is not a substitute for calling emergency services (e.g., 911)

  • We do not monitor recordings in real time

  • We do not intervene in emergencies

 

2. ELIGIBILITY

You must be at least 18 years old to use the Services. By using Witness, you represent and warrant that you meet this requirement.

 

3. USER RESPONSIBILITIES

You agree to use the Services lawfully and responsibly.

You agree NOT to:

  • Record or share content in violation of applicable laws

  • Infringe on the rights or privacy of others

  • Upload malicious code or attempt to interfere with the Services

  • Use Witness for harassment, stalking, or illegal surveillance

  • Misrepresent yourself or impersonate others

You are solely responsible for:

  • The content you record or upload

  • Ensuring you have the legal right to record in your jurisdiction

  • Obtaining consent where required by law

 

4. RECORDINGS AND CONTENT

Ownership

You retain ownership of all videos and content you create using Witness.

By using the Services, you grant the Company a limited, non-exclusive license to store, process, transmit, and display your content solely for the purpose of operating the Services and at your direction.

Sharing

Content is shared only:

  • With your Trusted Circle, as configured by you

  • With service providers strictly necessary to operate the Services

  • When required by law or valid legal process

The Company does not publish or make content public by default.

 

5. TRUSTED CIRCLE

You are responsible for:

  • Selecting who you add to your Trusted Circle

  • Ensuring you have permission to share content with them

We are not responsible for:

  • Actions taken by Trusted Circle members

  • Redistribution or misuse of content by recipients

 

6. SUBSCRIPTIONS AND PAYMENTS

Certain features may require a paid subscription.

All payments are processed through the Apple App Store. We do not store payment information.

Subscriptions automatically renew unless canceled through your Apple ID settings.

Refunds are governed by Apple’s policies.

 

7. TERMINATION

We may suspend or terminate your access to the Services at any time if you violate these Terms or applicable law.

You may stop using the Services at any time. Termination does not affect any accrued rights or obligations.

 

8. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that:

  • The Services will be uninterrupted or error-free

  • Recordings will always upload successfully

  • Content will be preserved in all circumstances

 

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

IN NO EVENT SHALL MOTION VENTURES LLC BE LIABLE FOR:

  • PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE

  • LOSS OF EVIDENCE, DATA, OR RECORDINGS

  • INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES

OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

 

10. INDEMNIFICATION

You agree to indemnify and hold harmless the Company, its members, officers, and contractors from any claims, damages, or liabilities arising from:

  • Your use of the Services

  • Your violation of these Terms

  • Your content or recordings

 

11. THIRD-PARTY SERVICES

The Services may rely on third-party services (such as cloud storage or analytics). We are not responsible for outages or failures caused by third parties.

Links to third-party websites are provided for convenience only.

12. CHANGES TO THE SERVICES OR TERMS

We may modify or discontinue the Services at any time.

We may update these Terms from time to time. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.

 

13. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles.

Any dispute arising out of these Terms shall be resolved through binding arbitration in Arizona, unless the Company elects otherwise.

 

14. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

 

15. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Company regarding the Services.
